  1. Agreement to our Legal Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Hey Apps LLC ("Hey Apps," "we," "us," or "our"), governing your access to and use of the Hey Supplement mobile application (the "App"). These Terms apply to your use of the App and any related features, services, content, tools, or updates, unless such services are governed by separate terms.

These Terms incorporate by reference our Privacy Policy and any other legal notices or policies made available within the App. By downloading, installing, accessing, or using the App, you: (a) acknowledge that you have read and understood these Terms; (b) represent that you have the legal capacity to enter into a binding agreement; and (c) agree to be bound by these Terms.

Hey Apps reserves the right, at its sole discretion, to modify, amend, or replace these Terms at any time. We may notify you of material changes as required by applicable law, including through updates to this page or within the App interface (e.g., a banner or notice on launch). Unless otherwise specified, revised Terms become effective upon posting. Your continued use of the App after any such modifications signifies your acceptance of the revised Terms.

The App and its features may evolve over time. We may, without notice and at our discretion, add, remove, or modify functionality, suspend or discontinue parts of the App, or implement technical updates, patches, or changes in compatibility with certain devices or operating systems. It is your responsibility to ensure you are using the most recent version of the App.

These Terms govern your use of the App and apply regardless of the method by which you access or interact with it. The App is currently made available exclusively through the Apple App Store, and any use of the App is subject to these Terms.

2. Eligibility

The App is intended for use only by individuals who are at least eighteen (18) years old. By accessing, downloading, or using the App, you represent and warrant that you are at least 18 years of age and legally permitted to use the App under the laws of your jurisdiction. If you are under 18, you may not use or attempt to access the App under any circumstances.

We do not market, target, or provide services to individuals under the age of 18. The App is not directed to minors, and we do not knowingly collect personal information from anyone under this age threshold. If we become aware that we have collected personal data from someone under 18 without verified consent from a legally authorized guardian (if such consent is even applicable under your local law), we will take steps to promptly delete such data and may disable access to the App.

You are solely responsible for ensuring that your use of the App complies with all applicable local, national, and international laws, rules, and regulations. By using the App, you confirm that your access is lawful in your jurisdiction and that you are not subject to any restrictions or prohibitions that would make such access or use unlawful.

Access to the App is void where prohibited. We reserve the right to refuse service, restrict availability, or block access to the App in any location or to any individual if we have reason to believe the Terms or applicable laws are being violated.

3. License and Intellectual Property

Subject to your compliance with these Terms, Hey Apps LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App solely for your personal, non-commercial use on a compatible device that you own or control. This license is provided solely to enable your lawful use of the App as intended by Hey Apps and does not convey any ownership rights in the App.

You may not modify, copy, reproduce, publish, license, create derivative works from, sell, resell, distribute, or otherwise exploit any portion of the App or its content, except as expressly permitted under these Terms. Any attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the App is strictly prohibited, unless allowed under applicable law.

All rights, title, and interest in and to the App—including all content, text, graphics, user interfaces, visual design, code, features, and the underlying technology—are and will remain the exclusive property of Hey Apps LLC or its third-party licensors. The App and its content are protected by copyright, trademark, and other intellectual property laws.

All trademarks, service marks, logos, and trade names appearing in the App are the property of Hey Apps or their respective owners. You may not use any of these marks without prior written permission from the rights holder. Nothing in these Terms grants you any rights to use Hey Apps’ names, trademarks, logos, domain names, or other brand elements, whether for commercial or non-commercial use.

4. User Content

You may upload or submit content through the App, including but not limited to photographs of product labels, packaging, barcodes, or similar material (“User Content”). You retain ownership of any intellectual property rights that you hold in the User Content you create and submit.

By submitting User Content, you grant Hey Apps LLC a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, host, store, reproduce, analyze, modify, and display your User Content solely for the purposes of operating, improving, and maintaining the App’s functionality. This may include, for example, label recognition, ingredient parsing, supplement data extraction, and other features powered in part by third-party AI services such as OpenAI.

To avoid any doubt, you acknowledge and agree that:

  • User Content may be stored and processed on servers operated by Hey Apps or its partners for the purpose of supporting the App’s core features;

  • We do not claim ownership of your User Content, and nothing in these Terms restricts your ability to use or share it outside the App;

  • You will not upload any content that contains personal data, including but not limited to names, faces, contact details, or health-related identifiers of any individual;

  • You understand that the App does not verify the legality, accuracy, or source of any submitted User Content;

  • You are solely responsible for ensuring that your User Content does not infringe any third-party rights, including intellectual property, privacy, or publicity rights.

We reserve the right—but do not assume the obligation—to review, block, or remove User Content at our discretion, including if we believe it violates these Terms or applicable law.

You must not use the App to upload any content that is unlawful, misleading, deceptive, defamatory, harmful, or intended to interfere with the operation of the App or the experience of other users.

Processing of User Content may also be governed by our Privacy Policy, which explains how we handle, store, and protect your data.

5. About The App

The App is developed for educational and informational purposes related to dietary supplements. It allows users to scan barcodes or take photos of supplement packaging to obtain structured information about the products, such as ingredient lists, allergens, manufacturer details, expiration dates, and certifications.

The App is intended to help users explore supplement compositions and make better-informed choices based on their individual preferences and needs. It is provided solely for personal, non-commercial use. A full description of the App’s features can be found on its App Store page.

6. Health Disclaimer

The App and all information provided within it are intended for general informational and educational purposes only. The App does not provide medical advice, diagnosis, or treatment, and no part of its content should be interpreted as such.

Information presented in the App — including data about ingredients, dosages, allergens, or health effects — may not reflect the most current research or medical guidance. The App is not reviewed or approved by the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), or any other governmental health authority.

You should always read the full product label and consult a qualified healthcare professional before taking any dietary supplement or making changes to your health routine. Reliance on any information provided by the App is solely at your own risk.

If you experience any adverse reactions or have concerns about a supplement, discontinue use immediately and seek professional medical advice.

7. Subscriptions And Payments

Certain features or content within the App may be available only through a paid subscription or one-time in-app purchase (“Subscription”). All payments and billing for Subscriptions are processed through Apple’s App Store using your Apple ID account in accordance with Apple’s applicable terms, conditions, and policies. Hey Apps LLC does not collect or store any payment information.

If you purchase a Subscription, you agree that your Subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the current period expires. The renewal will be charged to your Apple ID account at the same rate unless you are notified of a price change prior to renewal. If a free trial is offered, it will automatically convert to a paid Subscription unless canceled before the trial period ends. Only one free trial may be available per Apple ID account.

Prices and availability of Subscriptions may change from time to time. We reserve the right to modify or discontinue, temporarily or permanently, any Subscription plan or feature, with or without notice, in accordance with applicable law. If a change materially affects your paid access, we will notify you through reasonable means (e.g., App Store notice or in-App message).

All payments are final.
Refund requests are handled solely by Apple in accordance with its refund policy. Hey Apps LLC is not responsible for processing or approving refund requests.

Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple shall have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof. You acknowledge that this agreement is solely between you and Hey Apps LLC, not Apple, and Apple has no responsibility for the App or its content.

8. Third -Party Services

The App may incorporate, rely on, or provide access to third-party software, APIs, data sources, or services that are not owned or controlled by Hey Apps LLC (“Third-Party Services”). These may include artificial intelligence technologies and data processing services such as OpenAI API integrations used to analyze supplement labels or generate informational outputs.

By using the App, you acknowledge and agree that:

  • The performance and availability of certain features depend on Third-Party Services;

  • Hey Apps LLC does not control and is not responsible for the content, accuracy, or reliability of data provided by Third-Party Services;

  • Use of Third-Party Services may be subject to additional terms, conditions, or privacy policies established by their respective providers (for example, OpenAI Terms of Use: https://openai.com/policies/terms-of-use);

  • We do not guarantee that any Third-Party Service will continue to be available, uninterrupted, or error-free.

Hey Apps LLC is not liable for any damages or losses arising from your interaction with or reliance upon Third-Party Services. Your use of these services is at your own discretion and risk.

9. Mobile Application License

You agree to use the App only for lawful, legitimate, and personal purposes in accordance with these Terms. You must not use the App in any way that could harm Hey Apps LLC, other users, or any third party, or that could interfere with the normal operation of the App.

In particular, you agree not to:

  • Upload, share, or submit any content that is unlawful, misleading, defamatory, obscene, offensive, or otherwise inappropriate;

  • Upload content that infringes or violates the intellectual property, privacy, or publicity rights of others;

  • Use the App to collect or attempt to collect personal data of other individuals;

  • Introduce viruses, malware, bots, or other harmful code or disrupt the App’s functionality;

  • Use automated tools or scripts to scrape, mine, or extract data from the App or its services;

  • Attempt to gain unauthorized access to the App, its systems, or related networks;

  • Circumvent, disable, or otherwise interfere with security or access controls;

  • Use the App for commercial purposes, resale, or distribution without prior written consent from Hey Apps LLC;

  • Misrepresent your identity or upload any content intended to deceive, impersonate, or manipulate results.

We reserve the right to monitor usage patterns and, at our discretion, suspend or terminate access to the App for any user who violates these Terms or applicable laws. Such actions may be taken without notice if we believe it necessary to protect the App, its users, or third-party rights.

10. Limitation Of Liability

To the fullest extent permitted by applicable law, Hey Apps LLC, its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or related to:

Your access to or use of (or inability to access or use) the App;

  • Any conduct or content of any third party, including other users or external data providers;

  • Any errors, inaccuracies, or omissions in information provided through the App;

  • Any unauthorized access to or alteration of your transmissions or data;

  • Any bugs, technical failures, or interruptions in App functionality.

In no event shall the total liability of Hey Apps LLC exceed the greater of:

(a) ten U.S. dollars (US $10), or
(b) the total amount paid by you, if any, for access to the App during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, such as liability for gross negligence, intentional misconduct, or fraud.

You acknowledge and agree that your use of the App is at your own risk and that you are solely responsible for any damage to your device, loss of data, or other harm resulting from such use.

11. Termination

Hey Apps LLC reserves the right to suspend or terminate your access to the App, or any part of it, at any time and for any reason, including but not limited to: violation of these Terms, illegal use of the App, abuse of functionality, or actions that may harm Hey Apps, its users, or third parties.

Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop using and delete all copies of the App from your devices. We may also, at our discretion, disable access to any associated data or remove content that you have submitted through the App if it violates these Terms or applicable law.

Termination of access does not affect any provisions of these Terms that by their nature should survive, including but not limited to: intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law.

You may stop using and uninstall the App at any time.
Uninstalling or ceasing to use the App does not entitle you to any refund of payments already made, except where required by applicable law or Apple’s refund policy.

We reserve the right to modify, suspend, or discontinue the App, or any part of it, at any time without notice, and we shall not be liable for any consequences resulting from such actions.

12. Governing Law And Dispute Resolution

These Terms and any dispute or claim arising out of or related to them, their subject matter, or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

You agree that any legal suit, action, or proceeding arising out of or related to these Terms or the App shall be instituted exclusively in the state or federal courts located within the State of California, and you consent to the personal jurisdiction of such courts.

To the fullest extent permitted by applicable law, you and Hey Apps LLC agree to waive any right to a trial by jury or to participate in a class action or representative proceeding related to the App or these Terms. Each party agrees to bring claims only in its individual capacity.

If any provision of this section is found unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, while the remaining provisions shall continue in full force and effect.

13. Changes To Terms

Hey Apps LLC reserves the right to update, modify, or replace these Terms at any time to reflect changes in our practices, legal requirements, or features of the App.

When changes are made, we will update the “Last Updated” date at the top of this document. If a revision is material, we will notify you through reasonable means, such as an in-App notice or update information on the App Store page.

Unless otherwise specified, the revised Terms will become effective immediately upon posting. Your continued use of the App after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using and delete the App from your device.
